Refund policy
SMILE DAZZLE RETURNS, REFUNDS & WARRANTY POLICY
Last Updated: 15 September 2026
At Smile Dazzle, we want you to be completely satisfied with your purchase.
This Returns, Refunds & Warranty Policy explains the circumstances under which products purchased from Smile Dazzle may be returned, exchanged, repaired or refunded.
This policy applies to purchases made through the Smile Dazzle online store and is intended to operate in accordance with applicable South African law, including the Consumer Protection Act 68 of 2008 ("CPA") and the Electronic Communications and Transactions Act 25 of 2002 ("ECTA"), as amended from time to time.
Nothing in this policy is intended to exclude, restrict or waive any consumer right that cannot legally be excluded, restricted or waived.
1. CHANGE-OF-MIND RETURNS
Where the statutory cooling-off provisions of ECTA apply to your purchase, you may have the right to cancel your transaction without giving a reason and without penalty within 7 days after receiving the goods, subject to the exceptions and requirements contained in ECTA.
Where this statutory cooling-off right applies, the consumer is responsible for the direct cost of returning the goods, as permitted by law.
If you wish to exercise an applicable cooling-off right, you must notify Smile Dazzle within the applicable period and follow our return instructions.
Once the product has been returned in accordance with the applicable requirements, Smile Dazzle will process any refund required by law.
The statutory cooling-off right does not apply to every transaction. ECTA contains specific exceptions.
2. CONDITION OF CHANGE-OF-MIND RETURNS
For a change-of-mind return, customers should return the product in substantially the same condition in which it was received, allowing only reasonable inspection and handling necessary to determine whether they wish to keep the product.
Where reasonably possible, the return should include:
-
the Smile Dazzle charger;
-
all cables and accessories supplied with the product;
-
manuals or instructions;
-
original packaging; and
-
any other components supplied as part of the order.
Customers should not continue using the charger once they have decided to return it.
This section does not limit any statutory rights relating to defective, unsafe or incorrectly supplied goods.
3. DEFECTIVE OR FAULTY PRODUCTS
Smile Dazzle recognises the consumer protections provided by the CPA.
Consumers are entitled to goods that satisfy the applicable requirements of section 55 of the CPA, including goods that are of good quality, in good working order and free from defects and that are reasonably suitable for their intended purpose.
If the Smile Dazzle charger fails to satisfy these applicable requirements within the statutory period, the consumer may have the right to return the product in accordance with section 56 of the CPA.
Where section 56 applies, the consumer may direct Smile Dazzle to:
-
repair the product;
-
replace the product; or
-
refund the price paid for the product.
Smile Dazzle will provide the remedy required by applicable law.
4. SIX-MONTH STATUTORY WARRANTY
The CPA provides an implied warranty of quality for qualifying goods.
Where applicable, if the product fails to satisfy the requirements and standards contemplated by section 55 within 6 months after delivery, the consumer may return the product without penalty and at the supplier's risk and expense.
The consumer may direct the supplier to repair or replace the failed, unsafe or defective product, or refund the price paid, subject to the CPA.
If Smile Dazzle repairs a product and the same failure or a further failure occurs within the applicable statutory period following that repair, the additional remedies provided by section 56 may apply.
Nothing in this policy limits these statutory rights.
5. WHAT MAY CONSTITUTE A DEFECT?
Depending on the circumstances, a potential product defect may include:
-
the charger does not charge a compatible device as represented;
-
the self-ejecting mechanism fails during normal intended use;
-
the automatic disconnect function does not operate as represented;
-
the product repeatedly disconnects during normal intended use;
-
the product fails prematurely under normal intended conditions;
-
the product is materially different from its advertised specifications;
-
the product does not perform its advertised function; or
-
the product presents a safety defect during intended use.
Smile Dazzle may reasonably assess the reported issue to determine the cause of the failure and the remedy applicable under law.
6. MISUSE, ACCIDENTAL DAMAGE AND UNAUTHORISED MODIFICATION
Smile Dazzle is not responsible, to the extent permitted by applicable law, for failures or damage caused by misuse, abuse, negligence, accidental damage or use outside the product's intended purpose.
Examples may include:
-
dropping or crushing the charger;
-
bending, breaking or physically damaging the product;
-
deliberately forcing the self-ejecting mechanism;
-
attempting to manually disable or interfere with the ejecting mechanism;
-
opening or disassembling the charger;
-
rewiring or modifying the product;
-
attempting an unauthorised repair;
-
exposing the product to liquids where it is not advertised as water-resistant;
-
exposing the product to excessive heat;
-
using incompatible power supplies or charging equipment contrary to the product instructions;
-
using damaged third-party cables, plugs or chargers;
-
using the product outside its stated electrical specifications;
-
using the product for a purpose for which it was not designed; or
-
failing to follow supplied safety instructions.
Where applicable, Smile Dazzle may request evidence or inspect the product to determine whether reported damage resulted from a product defect or from circumstances occurring after delivery.
This section does not remove any statutory consumer right that applies notwithstanding misuse or damage.
7. UNAUTHORISED REPAIRS OR MODIFICATIONS
Customers should not attempt to open, repair, rewire or modify the charger.
If the product has been opened, modified or repaired by the customer or an unauthorised third party, Smile Dazzle may assess whether that modification caused or contributed to the reported failure.
A statutory remedy will not be denied merely because a product was modified unless applicable law permits such denial.
8. NORMAL WEAR AND TEAR
Normal deterioration resulting from reasonable use does not automatically constitute a manufacturing defect.
Examples may include:
-
minor cosmetic scratches;
-
ordinary cosmetic deterioration;
-
normal wear to external surfaces; or
-
deterioration resulting from ordinary use over time.
However, where a product fails to meet applicable statutory requirements, the customer's statutory rights remain unaffected.
9. INCORRECT PRODUCT OR ORDER
If you receive a product that is different from the product you ordered, an incorrect quantity, or a product that materially differs from its advertised description, please contact Smile Dazzle.
We may request photographs showing:
-
the product received;
-
the packaging;
-
the shipping label; and
-
the contents of the package.
Where the product was supplied incorrectly, Smile Dazzle will provide the remedy required by applicable law.
10. PRODUCTS DAMAGED DURING DELIVERY
If your Smile Dazzle charger arrives visibly damaged, please contact us as soon as reasonably possible.
We may request photographs or video showing:
-
the product;
-
the external packaging;
-
the shipping label; and
-
the damage.
This allows us to investigate the matter with the relevant courier or fulfilment provider.
Where applicable law requires Smile Dazzle to provide a remedy, the applicable statutory rights will apply.
11. COMPATIBILITY
Before purchasing, customers are responsible for reviewing the compatibility information and product specifications displayed on the Smile Dazzle website.
The charger should only be used with devices, charging equipment, cables, power supplies and charging standards that are stated to be compatible with the product.
Smile Dazzle cannot guarantee compatibility with every device or charging setup available on the market.
Where a product was incorrectly advertised or the product materially differs from the compatibility information represented by Smile Dazzle, the customer's statutory rights remain unaffected.
However, Smile Dazzle is not responsible for incompatibility caused solely by a customer's use of unsupported third-party equipment or devices outside the specifications communicated by Smile Dazzle.
12. ELECTRICAL SAFETY
Customers must follow all safety instructions supplied with the product.
Do not use the charger if you notice:
-
exposed wiring;
-
melting;
-
burning smells;
-
unusual heat;
-
sparks;
-
physical damage;
-
damaged connectors;
-
frayed cables; or
-
any other unusual or potentially unsafe condition.
If any of these conditions occur, immediately stop using the product and contact Smile Dazzle.
Customers should never attempt to repair an electrical product themselves.
Smile Dazzle is not responsible, to the extent permitted by applicable law, for damage resulting from the use of damaged, incompatible or improperly installed third-party charging equipment.
13. THIRD-PARTY DEVICES AND ACCESSORIES
The Smile Dazzle charger may be compatible with third-party devices and accessories specified on the product page.
Compatibility depends on the relevant device, connector, charging standard, power supply and other technical specifications.
Customers are responsible for ensuring that their charging setup complies with the compatibility requirements communicated by Smile Dazzle.
Where a failure is caused by incompatible third-party equipment rather than a defect in the Smile Dazzle product, Smile Dazzle may not be responsible for that failure to the extent permitted by law.
14. USED PRODUCTS
Use of a product does not automatically remove a consumer's statutory rights.
However, a customer exercising a change-of-mind right should only handle and inspect the product to the extent reasonably necessary to determine whether they wish to keep it.
Where a customer claims that a used product is defective, Smile Dazzle may reasonably inspect the product to determine whether the reported issue constitutes a defect covered by applicable law.
15. PRODUCT INSPECTION
For certain return requests, Smile Dazzle may reasonably request:
-
proof of purchase;
-
photographs;
-
video demonstrating the issue;
-
the order number;
-
product serial or identifying information, where applicable;
-
information about the device used;
-
information about the charger or power supply used; and
-
a description of the circumstances in which the issue occurred.
Where reasonably necessary and legally permitted, Smile Dazzle may require the product to be returned for physical inspection.
An inspection is intended to identify the cause of the reported problem and does not remove statutory consumer rights.
16. RETURN SHIPPING
Change-of-mind return
Where a statutory ECTA cooling-off right applies, the consumer is responsible for the direct cost of returning the product, as permitted by ECTA.
Defective or unsafe product
Where the CPA requires the supplier to bear the cost of returning defective or unsafe goods, Smile Dazzle will do so as required by law.
Incorrect product
Where Smile Dazzle supplied the wrong product, we will provide the applicable remedy required by law.
Smile Dazzle will not require a consumer to pay costs that applicable law places on the supplier.
17. REFUNDS
Where a refund is required or approved, Smile Dazzle will process the refund using the original payment method where reasonably possible.
The time taken for funds to appear in a customer's account may depend on the relevant bank, card issuer or payment provider.
Smile Dazzle is not responsible for delays caused solely by third-party financial institutions or payment processors.
Where a specific refund period is prescribed by applicable law, Smile Dazzle will comply with that requirement.
18. REPAIRS AND REPLACEMENTS
Where a product qualifies for a statutory remedy, Smile Dazzle will provide the remedy required by law.
Where the consumer has a statutory right to select a particular remedy, Smile Dazzle will respect that right.
Any voluntary repair, replacement or goodwill gesture offered by Smile Dazzle does not remove or reduce statutory consumer rights.
19. FRAUDULENT OR ABUSIVE RETURN CLAIMS
Smile Dazzle reserves the right, subject to applicable law, to investigate suspected fraudulent or abusive return claims.
This may include situations where a customer:
-
returns a different product from the one purchased;
-
deliberately damages a product and claims that it was defective;
-
provides knowingly false information;
-
submits manipulated photographs or videos;
-
seeks multiple refunds for the same purchase; or
-
attempts to obtain both a refund and replacement for the same issue without legal entitlement.
Nothing in this section permits Smile Dazzle to refuse a remedy that is legally required.
20. DELIVERY DELAYS
Smile Dazzle will endeavour to deliver orders within the delivery timeframe communicated to the customer.
Where applicable legislation provides a consumer with a right to cancel because an order has not been delivered within the applicable agreed or statutory period, Smile Dazzle will comply with that right.
If Smile Dazzle is unable to fulfil an order because the product is unavailable, the customer will be notified and any refund required by law will be processed.
21. ECTA COOLING-OFF RIGHTS
Qualifying online transactions may be subject to the cooling-off provisions of ECTA.
Under the applicable ECTA provisions, a consumer may generally cancel a qualifying transaction for goods within 7 days after receiving the goods, without giving a reason and without penalty, subject to statutory exceptions.
The direct cost of returning the goods may be charged to the consumer.
ECTA contains exceptions to the cooling-off right, and the right does not apply to every transaction or product.
Nothing in this policy is intended to restrict a right provided to consumers by ECTA.
22. NO WAIVER OF STATUTORY RIGHTS
Nothing contained in this policy:
-
excludes the Consumer Protection Act;
-
excludes ECTA;
-
removes a statutory warranty;
-
prevents a consumer from exercising a statutory remedy;
-
requires a consumer to waive a statutory right;
-
excludes liability that cannot legally be excluded; or
-
limits a consumer's rights beyond what South African law permits.
If any provision of this policy conflicts with a mandatory provision of South African law, the applicable law will prevail.
The remaining provisions will continue to apply to the extent legally permissible.
23. HOW TO REQUEST A RETURN
To request a return, contact Smile Dazzle through the customer-service contact details displayed on our website.
Please provide:
-
your full name;
-
order number;
-
date of purchase;
-
product purchased;
-
reason for the return;
-
photographs or video where relevant; and
-
any other reasonable information required to process the request.
Please do not send a product to us without first receiving return instructions.
This helps ensure that your return is correctly identified and processed.
24. PROOF OF PURCHASE
Smile Dazzle may request reasonable proof that the product was purchased from our store.
This may include:
-
an order number;
-
order confirmation;
-
invoice;
-
payment confirmation; or
-
other reasonable proof of purchase.
The absence of original packaging does not, by itself, remove a statutory consumer right where applicable law does not permit such a restriction.
25. CUSTOMER RESPONSIBILITY
Customers are responsible for using the charger in accordance with the supplied instructions and safety warnings.
Customers should:
-
use compatible equipment;
-
avoid exposure to liquids where applicable;
-
avoid excessive heat;
-
inspect the product before use;
-
stop using the product if it becomes damaged; and
-
never attempt unauthorised repairs or modifications.
26. CONTACT INFORMATION
For returns, refunds, warranty claims or product-support enquiries, please contact Smile Dazzle using the customer-service contact details published on our website.
Please include your order number in all correspondence.
27. GOVERNING LAW
This policy is governed by the laws of the Republic of South Africa.
Any dispute arising from a purchase will be dealt with in accordance with applicable South African law and any applicable consumer dispute-resolution mechanisms.
SMILE DAZZLE
This Returns, Refunds & Warranty Policy should be read together with Smile Dazzle's Terms & Conditions, Privacy Policy, Shipping Policy and any product-specific safety instructions.
Legal notice: This is an ecommerce policy template intended to align with applicable South African consumer law. It is not a substitute for advice from a South African attorney. Smile Dazzle should have the final version reviewed by a qualified South African legal professional before publication, particularly because the product is an electrical/charging device.
